Law | Burlington, VT Bans Smoking In Outdoor Mall

On Monday night, November 10th, 2014 the city council in Burlington, Vermont voted to ban smoking at the popular Church Street Marketplace. The council voted 11-3 to ban smoking 24 hours a day sever days a week. No date was issued for enforcement, but the president of the Burlington City Council expected the ban will be enforced before the end of the year.

The Church Street Marketplace is an outdoor pedestrian mall that is home to stores, restaurants and bars. Violators will face a $50 fine for the first offense and $100 for a second offense.

According to a resident that lives above one of the stores, “I feel like that’s infringing on my right as a smoker to smoke in an open area where it’s not contained.”

Burlington, Vermont is home to 42,000 residents over 15.5 square miles and was established in 1783.
