Santa Clara County, California which includes cities such as Cupertino and San Jose has become the first jurisdiction in the western Unites States to ban the sale of flavored tobacco.
The Board of Supervisors approved the new law on Tuesday night that prohibits general retailers from selling flavored tobacco in unincorporated areas within the county.
Retailers who sell the tobacco will have to comply with the ban within 90 days and the Department of Environmental Health will conduct annual inspections to make sure that the tobacco is no longer sold except in adults-only tobacco businesses.
The ban does not apply to businesses that sell tobacco products to adults only, and defined as those business generating at least 60% of their gross revenue from tobacco related sales and do not allow minors in without a parent or guardian.
Santa Clara County is home to 1.8 million people over 1,304 square miles and was incorporated in 1850.
