The Connecticut-based cigar company “Connecticut Valley Tobacconist” has filed a trademark infringement lawsuit in the U.S. District Court for the Eastern District of Pennsylvania against La Flor Dominicana.
The plaintiff (Connecticut Valley Tobacconist) has also filed suit against Harry’s Smoke Shop, a cigar shop that carries both brands in Philadelphia. The plaintiffs are seeking the destruction of infringing products, plus compensatory and punitive damages
The complaint states that the plaintiff created the Mysterioso brand of cigar in January 2003, and successfully registered the name in 2007 and renewed it in 2012 with the U.S. Patent and Trademark Office.
The plaintiffs claim that La Flor Dominicana created its Mysterio brand of cigars shortly after the release of the Mysterioso. According to the lawsuit, La Flor tried to register its own trademark but was allegedly denied by the U.S. Patent and Trademark Office.
The plaintiff allegedly sent several cease and desist letters to La Flor Dominicana, which have been ignored.
